1. INTRODUCTION AND ACCEPTANCE

Welcome to Howazt Feedback Manager (“we,” “us,” “our”), a platform operated by DigiKing Service Provider, the Data Controller responsible for the processing of personal data 

These Terms of Service (“Terms”) govern your access to and use of the Howazt admin web application, including all features, services, and functionalities (collectively, the “Service”).

By accessing or using the Service, you (“you,” “your,” “User”) agree to be bound by these Terms.

If you are accessing or using the Service on behalf of an organization or entity, you represent and warrant that you have the authority to bind such organization to these Terms. In such cases, “you” refers to both you and the organization.

If you do not agree to these Terms, you may not use the Service.


2. DESCRIPTION OF SERVICE

Howazt Feedback Manager is an event feedback management and social media amplification platform that enables event organizers to:

  • Create and manage events (details, locations, dates, QR codes)
  • Collect attendee feedback (text, video, audio, star ratings)
  • Review, approve, or reject feedback
  • Automatically compile highlight videos
  • Publish content to social media (Facebook, Instagram, YouTube)
  • Track engagement analytics (views, likes, shares, reach, comments)
  • Manage social media integrations via OAuth

The Service is accessed via a secure web dashboard using Google OAuth 2.0 authentication.


3. USER ACCOUNTS AND AUTHENTICATION

3.1 Account Eligibility

You must be at least 18 years old to use the Service.

3.2 Authentication Method

  • Uses Google OAuth 2.0
  • Requires a valid Google account
  • Collects name and email for account creation

3.3 Account Responsibility

You are responsible for:

  • Maintaining account security
  • All activity under your account
  • Reporting unauthorized access immediately

3.4 Account Verification

We may verify your account and reserve the right to suspend or terminate accounts at our discretion.


4. USER OBLIGATIONS AND PROHIBITED CONDUCT

4.1 Legal Compliance

You must comply with:

  • Data protection laws (GDPR, CCPA, etc.)
  • Intellectual property laws
  • Social media platform policies
  • Consent requirements

4.2 Content Responsibility

You are responsible for all content you:

  • Submit
  • Approve
  • Publish

You must ensure:

  • Proper consent is obtained
  • No legal rights are violated
  • Content is lawful and accurate

4.3 Prohibited Uses

You may NOT:

  • Collect data without consent
  • Upload illegal or harmful content
  • Reverse-engineer the Service
  • Send spam
  • Access systems without authorization
  • Manipulate workflows
  • Violate API policies
  • Collect sensitive personal data
  • Impersonate others

Upload or process sensitive personal data (such as health information, financial data, government identifiers, or biometric data) 

4.4 Social Media API Compliance

You must:

  • Use only authorized accounts
  • Follow API rules
  • Protect OAuth tokens
  • Not manipulate engagement

5. INTELLECTUAL PROPERTY RIGHTS

5.1 Your Content

You retain ownership of your content.

You grant Howazt Feedback Manager a license to:

  • Store
  • Process
  • Display

For social media publishing, you allow:

  • Formatting and optimization
  • Caption generation
  • API submission

5.2 Service Ownership

All platform components belong to DigiKing Service Provider and are legally protected.

5.3 Generated Videos

Generated videos combine your content and Howazt Feedback Manager templates.
You may use them freely if proper rights are obtained.


6. PRIVACY AND DATA PROTECTION

Refer to our Privacy Policy for full details.

6.1 Data Collected

  • Personal info (name, email)
  • Event data
  • Feedback (text, video, audio)
  • Media files
  • Social media tokens
  • Analytics data

6.2 Your Responsibilities

You must:

  • Inform users about data usage
  • Obtain consent
  • Provide data rights
  • Follow applicable laws

6.3 Data Security

We use:

  • HTTPS encryption
  • OAuth authentication
  • Secure storage
  • Cloudflare R2 storage
  • Security assessments

No system is 100% secure.

6.4 Data Sharing

We may share data with:

  • Social media platforms (for publishing content as directed by you)
  • Cloud infrastructure providers (for secure storage and processing)
  • Analytics tools (only for aggregated, non-personal insights)
  • Legal authorities where required by law

We do NOT sell personal data.


7. THIRD-PARTY INTEGRATIONS AND APIs

7.1 Platform Responsibility

Third-party platforms:

  • Are independent
  • May change APIs
  • May remove content

7.2 API Permissions

  • pages_show_list
  • pages_manage_posts
  • pages_read_engagement

Instagram:

  • instagram_basic
  • instagram_content_publish

YouTube:

  • youtube.upload
  • youtube.readonly

7.3 Token Security

Tokens are securely stored and can be revoked anytime.


8. FEES AND PAYMENT

8.1 Current Pricing

Free during development phase.

8.2 Future Pricing

We may introduce fees with:

  • 30-day notice
  • Clear pricing
  • Option to cancel

8.3 Refunds

All payments are non-refundable unless required by law.


9. CONTENT MODERATION WORKFLOW

  • Submission: Feedback submitted via QR
  • Review: Admin approves/rejects
  • Generation: Videos created from approved feedback
  • Publishing: Content posted to social platforms
  • Removal: Content can be unpublished

You are responsible for moderation. All feedback submitted by attendees undergoes admin review BEFORE publishing. Content is not published automatically. However, if harmful content is inadvertently published:

You must unpublish it immediately

Howazt Feedback Manager bears no liability for content published without proper review by the Customer

We reserve the right to suspend accounts publishing harmful content.


10. TERM AND TERMINATION

10.1 Term

Valid while you use the Service.

10.2 Termination by You

You may stop usage anytime.

10.3 Termination by Us

We may suspend or terminate access if:

  • Terms are violated
  • Security risk is detected
  • Illegal activity occurs

10.4 Effects

  • Access removed
  • Data may be deleted
  • External content remains

10.5 Data Retention

Data is permanently deleted (hard delete) upon account disconnection or deletion requests, in accordance with our Privacy Policy.

Limited non-personal system logs may be retained for security or legal compliance purposes, which do not contain identifiable user data.


11. LIMITATION OF LIABILITY

We are not liable for:

  • Data loss
  • Revenue loss
  • Service interruptions
  • Platform changes

Maximum liability:

  • $100 USD OR
  • Amount paid in last 12 months

12. DISCLAIMER OF WARRANTIES

Service is provided “AS IS” with no guarantees.

We do not guarantee:

  • Uptime
  • Accuracy
  • Error-free operation
  • Security
  • Platform compatibility

The Service may be subject to interruptions, delays, or limitations due to third-party platform dependencies (e.g., Meta, YouTube APIs). 


13. INDEMNIFICATION

You agree to protect Howazt Feedback Manager from claims arising from:

  • Your usage
  • Legal violations
  • Lack of consent
  • IP infringement

14. THIRD-PARTY LINKS

We are not responsible for external websites or services.


15. DISPUTE RESOLUTION

15.1 Governing Law

Laws of India apply.

15.2 Jurisdiction

Courts in India have authority.
